Apple vs Samsung: Beide gewinnen und verlieren in Mannheim

Es war mal ein paar Tage erstaunlich ruhig um die beiden Streithähne, vor dem LG Mannheim hat man sich dann aber heute mal wieder eingefunden um sich zu streiten: Samsung sollte das „Slide-to-unlock“-Patent verletzen und Apple ein 3G-Patent von Samsung

Beide Anträge wurden von dem LG Mannheim allerdings zurückgewiesen, keine einstweilige Verfügung gegen beziehungsweise für eine Partei. Samsung verletzt durch die Galaxy-Reihe nicht das „Slide-to-Unlock“-Patent und Apple beeinträchtigt keins von Samsung 3G-Patenten. Mehr Informationen werde ich nachreichen, sobald ich sie habe – erstmal habe ich ein Statement von Samsung zu beiden Urteilen:

Zu dem „Slide-to-Unlock“-Patent:
Samsung’s Statement Regarding Ruling Denying Apple Patent Lawsuit in Mannheim:
„Samsung welcomes the court’s ruling which confirms our position that the GALAXY range is distinctive and does not infringe Apple’s intellectual property.   The court has denied Apple’s claims, and Samsung’s innovative GALAXY range of devices will remain available for consumers in Germany.
Samsung will continue to assert our intellectual property rights and defend against Apple’s claims to ensure our continued innovation and growth in the mobile industry.“

Zu dem 3G-Patent:
Samsung’s Statement Regarding Lawsuit Against Apple in Mannheim:
„We are disappointed that the court did not share our views regarding the infringement by Apple of this specific patent in Germany. We will review the written grounds of today’s judgment and expect to lodge an appeal with the Higher Regional Court Karlsruhe.
It should be noted that Samsung filed a separate legal action with the Mannheim court in December 2011 relating to Apple’s infringement of four additional patents.  We will continue to assert our intellectual property rights and defend against Apple’s claims to ensure our continued ability to provide innovative mobile products to consumers.“
