Offiziell: Neue einstweilige Verfügung ist Schuld für das Verschwinden des Galaxy Tab 7.7

Gestern hatte ich ja bereits hier spekuliert, dass es eine neue einstweilige Verfügung gegeben haben könnte, nun hat Samsung gegenüber der südkoreanischen Nachrichtenagentur Yonhapnews offiziell bestätigt, dass Apple am Freitag eine neue einstweilige Verfügung  vor dem Landgericht Düsseldorf beantragt hatte und die Verfügung seitens des LG Düsseldorf erlassen wurde.

Die Entfernung des Samsung Galaxy Tab 7.7 von den Ständen auf der IFA ist als Reaktion auf diese neue einstweilige Verfügung zu sehen. Fraglich ist natürlich, wie das LG Düsseldorf am 9. September über die erste Verfügung gegen das Galaxy Tab 10.1 entscheiden wird – allerdings muss man sagen, dass das Fristenproblem, was es bei der ersten Verfügung noch gegeben haben könnte, nun bei der neuen Verfügung definitiv keine Rolle mehr spielen dürfte. Es wird interessant zu sehen, wie schnell Samsung ein Urteil in Alicante erreichen kann, sollte es dort jedoch zu einer „Aufhebung“ des Geschmacksmusters kommen, könnte sich die ganze Sache auch für Apple als nachteilig erweisen, dann nämlich wäre Apple aufgrund des ex tunc nichtigen Grundes für die einstweiligen Verfügungen schadensersatzpflichtig …

Samsung withdraws latest tablet computer from German trade show
SEOUL, Sept. 4 (Yonhap) — Samsung Electronics Co. said Sunday that it is not showcasing its latest Galaxy Tab tablet computer any more at the ongoing annual trade show in Germany in a bid to respect a German court’s approval of an injunction sought by Apple Inc.Samsung Electronics Co., the world’s second-biggest handset maker, unveiled the Galaxy Tab 7.7 for the first time at the annual trade fair, known as the IFA, which kicked off on Friday for a six-day run in Berlin. 

But Samsung pulled the tablet computer out of the show after a Dusseldorf court accepted on Friday Apple’s request to ban sales and marketing of the product in Germany, the company said.

Samsung Electronics has been in a global patent dispute with Apple that spans regions from Europe and Australia. The U.S. company claims that Samsung’s Galaxy series of products copied its best-selling iPad and iPhone.

Samsung Electronics said it will refute Apple’s claims and take legal actions so its smartphones and table computers business runs smoothly in Germany.

A Dusseldorf court on Aug. 16 accepted Samsung’s request to reverse an injunction against the sale of the Galaxy Tab 10.1 across Europe, excluding the Netherlands. The ruling caused the jurisdiction of the injunction to be scaled back only to Germany.
